1. Acceptance of Terms

By accessing or using GlobalProsEdge.ai (“GlobalProsEdge,” “Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the Services.

These Terms apply to all users, including free and paid subscribers.

2. Description of Services

GlobalProsEdge provides digital career intelligence tools including but not limited to:

  • TraitDNA™ work-style behavioral measurement
  • Best-Fit Occupation analysis
  • AI Work Exposure Index™
  • Hiring Demand insights
  • Compensation Alignment indicators
  • Labor market data visualization and reporting

The Services are informational and educational tools. GlobalProsEdge is not a recruiting firm, staffing agency, employment agency, or employer. We do not guarantee interviews, job offers, salary outcomes, or employment placement.

3. Eligibility

You must be at least 18 years old to use the Services.

By using GlobalProsEdge, you represent that:

  • You are legally able to enter into binding contracts
  • All information you provide is accurate and truthful

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts for false information or misuse.

5. Subscription Plans and Payments

GlobalProsEdge offers tiered subscription plans, including free and paid plans.

5.1 Billing

Paid subscriptions are billed monthly unless otherwise stated.

5.2 Auto-Renewal

Subscriptions automatically renew unless canceled before the renewal date.

5.3 Refunds

Unless required by law, subscription fees are non-refundable.

We reserve the right to modify pricing with reasonable notice.

6. No Employment Guarantee

GlobalProsEdge does not:

  • Act as an employer, recruiter, or staffing agency
  • Guarantee interviews, job offers, or salary outcomes
  • Guarantee hiring success based on certification or reports

All career decisions remain solely the responsibility of the user.

7. Informational Nature of Outputs

All scores, rankings, classifications, projections, indicators, labels (including AI Resilient, AI Augmented, AI Disrupted), compensation leverage scores, demand momentum indicators, and fit strength measures are informational only.

They are derived from benchmark models, occupational task mapping, and statistical analysis. They are probabilistic in nature and do not constitute professional, legal, financial, employment, or psychological advice.

Users are solely responsible for decisions made based on platform outputs.

8. Psychometric and Assessment Disclaimer

TraitDNA™ is a work-style behavioral measurement instrument intended for self-awareness and career insight.

TraitDNA:

  • Is not a clinical or medical assessment
  • Does not diagnose mental health conditions
  • Does not measure intelligence, aptitude, or protected characteristics
  • Is not intended to function as a sole selection device

TraitDNA is not designed to replace employer validation studies required under the Uniform Guidelines on Employee Selection Procedures (UGESP) or similar regulatory frameworks.

Users agree not to represent TraitDNA results as an employer-validated hiring instrument unless independently validated by the employer.

9. AI Modeling and Exposure Classification Disclaimer

The AI Work Exposure Index™, AI-adjusted fit scores, and related classifications are derived from task-level modeling across occupational datasets.

Labels such as AI Resilient, AI Augmented, and AI Disrupted reflect modeled exposure estimates to task-level automation risk. They do not predict layoffs, automation events, or employer-specific workforce changes.

Models are updated periodically. Users acknowledge that labor market conditions and AI capabilities evolve over time.

10. No Employment Relationship

  • GlobalProsEdge does not participate in hiring decisions
  • We do not rank candidates for specific employers
  • We do not influence employer screening systems

Any employer viewing a user’s certification, badge, or report does so independently. Employment decisions are made solely by employers.

11. EEOC and Employment Law

GlobalProsEdge does not make employment decisions and does not control employer hiring processes. Employers remain solely responsible for compliance with all applicable employment laws, including but not limited to:

  • Title VII of the Civil Rights Act
  • Americans with Disabilities Act (ADA)
  • Age Discrimination in Employment Act (ADEA)
  • State and federal anti-discrimination statutes

GlobalProsEdge disclaims liability for employment-related claims arising from employer use, misuse, or independent interpretation of user-shared information.

12. User Responsibilities

Users agree to:

  • Provide accurate information
  • Use the platform for lawful purposes
  • Not reverse engineer or replicate proprietary methodologies
  • Not use outputs in discriminatory or unlawful ways

Misuse may result in suspension or termination.

13. Intellectual Property

All software, scoring frameworks, methodologies, taxonomies, branding, visualizations, reports, and models are proprietary to GlobalProsEdge.

No rights are granted except limited personal use of Services as provided herein.

14. Limitation of Liability

To the maximum extent permitted by law, GlobalProsEdge shall not be liable for indirect, incidental, consequential, speculative, or punitive damages including, but not limited to:

  • Lost profits
  • Lost employment opportunities
  • Lost compensation
  • Business interruption
  • Reputational harm
  • Model error or statistical deviation
  • Third-party data inaccuracies

Total liability shall not exceed the amount paid by the user in the preceding twelve (12) months.

15. Indemnification

Users agree to indemnify and hold harmless GlobalProsEdge from claims arising from misuse of Services, misrepresentation of certification, or unlawful conduct.

16. Limitation on Model Reliance

The Services utilize proprietary statistical models, occupational taxonomies, benchmark datasets, and predictive frameworks to generate outputs including but not limited to:

  • Fit strength scores
  • AI Resilient, AI Augmented, and AI Disrupted classifications
  • Compensation alignment indicators
  • Hiring demand momentum indicators
  • Switching readiness indicators

Users expressly acknowledge that:

  • All outputs are model-derived estimates
  • Outputs reflect probabilistic interpretations of large-scale datasets
  • Models may contain assumptions, estimation error, bias limitations, or incomplete data
  • Models are subject to refinement, recalibration, and periodic revision

GlobalProsEdge does not warrant that any model output is accurate, predictive, or suitable for a particular decision. Users agree not to rely exclusively on model outputs for material employment, compensation, hiring, business, or financial decisions.

To the maximum extent permitted by law, GlobalProsEdge disclaims liability for reliance on any model-based output.

17. Mandatory Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration shall take place in Florida, unless otherwise required by applicable law.

The arbitrator shall have exclusive authority to resolve all threshold arbitrability issues, including scope and enforceability of this arbitration provision.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

18. Class Action Waiver

You agree that any arbitration or proceeding shall be conducted on an individual basis only.

You expressly waive the right to:

  • Participate in a class action
  • Participate in a collective action
  • Participate in a representative action
  • Act as a private attorney general
  • Join claims with other users

No arbitrator shall have authority to certify or hear any class, collective, or representative proceeding.

If this class action waiver is found unenforceable, the arbitration provision shall be null and void.

19. Jury Trial Waiver

To the fullest extent permitted by law, both parties waive any right to a trial by jury in any proceeding arising out of or relating to these Terms or the Services.

20. Exclusive Venue for Non-Arbitrable Claims

If a court determines that arbitration is unenforceable for a specific claim, such claim shall be brought exclusively in the state or federal courts located in Florida, and the parties consent to personal jurisdiction therein.

21. Enterprise Use Disclaimer

If the Services are accessed by or on behalf of an enterprise, employer, educational institution, or third party:

  • Such entity is solely responsible for compliance with employment, labor, privacy, and discrimination laws
  • GlobalProsEdge does not validate employer selection systems
  • GlobalProsEdge does not assume liability for enterprise implementation decisions

Any enterprise use beyond informational purposes requires separate written agreement.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

23. Survival

All provisions relating to intellectual property, arbitration, liability limitation, indemnification, and dispute resolution shall survive termination of these Terms.

24. Entire Agreement

These Terms constitute the entire agreement between the parties regarding the Services and supersede all prior agreements, representations, or understandings.
